What Is the O-1A?

The O-1A visa is for individuals who possess extraordinary ability in the sciences, education, business, or athletics — demonstrated by sustained national or international acclaim. Unlike the H-1B, the O-1A has no annual cap, no lottery, and is not limited to a single employer.

O-1A status is initially granted for up to three years and may be extended in one-year increments without limit. It is one of the most flexible and powerful nonimmigrant visa categories available to high-achieving STEM professionals.

Eligibility

USCIS requires evidence satisfying at least three of the following criteria, or evidence of a one-time major achievement such as a Nobel Prize, Pulitzer, or Olympic medal:

  • Membership: Membership in associations requiring outstanding achievement as a condition of entry
  • Press: Published material about the person in professional or major trade publications

  • Scholarly articles: Authorship of scholarly articles in professional journals or major media
  • Critical role: Employment in a critical or essential capacity for distinguished organizations
  • High salary: Remuneration commanding a high salary relative to others in the field
