What Is the E-3?

The E-3 visa was created exclusively for Australian nationals and closely mirrors the H-1B specialty occupation standard. The position must require a bachelor’s degree or higher in a specific field, and the beneficiary must hold that credential.

The E-3 has an annual cap of 10,500 visas — a number that has never been exhausted. Unlike the H-1B, E-3 applicants can apply directly at a U.S. consulate in Australia, bypassing the lottery entirely and often receiving a decision within days.

  • Must be an Australian citizen (not merely a permanent resident)
  • The position must qualify as a specialty occupation under standards similar to H-1B

  • A certified Labor Condition Application (LCA) from the Department of Labor is required prior to application
  • E-3 may also be filed as a change of status within the United States
